These General Terms and Conditions (T&C) apply to all contracts between Kinetic Pillar OÜ (trading as Exitmania) and the customer for digital outdoor escape games, city games and teambuilding products (private tickets and business bookings) via www.exitmania.com and related booking flows.
The contracting party is Kinetic Pillar OÜ, Tornimäe tn 5, 10145 Tallinn, Estonia (Exitmania). The customer books digitally provided game access via the website www.exitmania.com.
The presentation of games on our website does not constitute a legally binding offer, but a non-binding invitation to place an order. By clicking the "Complete Purchase" button, you place a binding order. The contract is concluded upon receipt of payment and our order confirmation by email.
Purchased tickets are valid for 12 months from the date of purchase and can be redeemed for the booked game within this period. A ticket entitles you to one-time use of the selected escape game.
After redeeming the ticket and starting the game, the validity expires after the playing time or at the latest after 48 hours. Extension or restoration is not possible.
For vouchers from third-party providers (e.g., GetYourGuide, Viator), the conditions of the respective provider apply. These vouchers are usually valid for longer and have special redemption conditions. Please note the information on the voucher.
Prices displayed on our website are shown in the currency applicable to your region. Taxes (e.g. VAT) are calculated and displayed during checkout, depending on the product and your location.
Payment processing is handled via Paddle. Paddle acts as the Merchant of Record (MoR). This means the payment is processed via Paddle and, depending on the checkout, Paddle may be your contractual partner for the payment transaction.
The payment methods shown during checkout may vary depending on the product/service and your country (e.g. credit card, PayPal, SEPA direct debit, bank transfer/invoice, and local payment methods).
Paddle issues the receipt/invoice for payments processed via Paddle. Depending on the checkout flow, Paddle may also appear as the payment recipient on your bank or card statement or in your payment confirmation.
Payment is due immediately when you place the order. If bank transfer/invoice is offered for a specific product or customer group, the due date and details are shown in the checkout or on the invoice.
After successful payment confirmation, you will receive an email with your personal access data for the booked game. For bank transfer/invoice payments, delivery may be delayed until payment has been confirmed.
The access data is sent to the email address provided during the order. Please also check your spam folder and ensure that the email address is correct.

Although the statutory right of withdrawal for digital content is excluded under § 312g para. 2 no. 9 BGB, we grant you a 14-day return right as a gesture of goodwill under the following conditions:
According to § 312g para. 2 no. 9 BGB, your right of withdrawal expires prematurely as soon as you have started the execution of the digital content (i.e. started the game). By starting the game, you expressly accept the loss of the right of withdrawal.
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of conclusion of the contract. To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g. by email to ticket@exitmania.com) of your decision to withdraw from this contract.
Exitmania is a digital platform for self-guided outdoor escape games, city games and teambuilding. The contractual service is the provision of digital game access (app-based content, puzzles, routes and related online tools such as event cockpit) plus remote live chat support for questions. Exitmania does not operate physical escape rooms, does not provide on-site guides or supervisors, and does not organise or run the physical outdoor activity as an event operator.
There is no Exitmania staff at the playing location. Exitmania has no duty of care or supervision (Aufsichtspflicht) for the physical presence, movement or behaviour of participants outdoors.
Exitmania can be reached remotely via live chat for questions about access, gameplay and technical issues. This remote support assists from afar; it does not mean Exitmania is present on site, does not create an on-site supervision duty, and does not replace the organiser’s or participants’ responsibility for safety in public space.
Gameplay typically takes place in publicly accessible areas (e.g. streets, squares, parks). By starting the game, participants acknowledge that outdoor participation involves general risks of public spaces (traffic, weather, uneven ground, other people, etc.). Participation is at the participants' own responsibility, to the extent permitted by applicable law.
If a company, public body, school, agency or other organiser books for a group, that organiser remains responsible for selecting suitable participants, briefing them on safety and local rules, obtaining any internal approvals, and arranging any insurance the organiser requires for its own event or employment context. Exitmania’s contract covers digital game access; it does not transfer organiser duties or venue/event operator duties to Exitmania.
Because Exitmania does not provide on-site supervision and does not operate the physical playing locations, Exitmania does not supply public liability insurance cover for the outdoor activity itself. Organisers who need such cover for their group or employer policies must arrange it themselves. This does not limit Exitmania’s statutory liability for its own digital services as set out in the liability section.

In case of defects in digital content, statutory warranty rights apply. Please report technical problems or defects immediately to ticket@exitmania.com. We will first offer remedial action before further warranty rights can be asserted.
The warranty is excluded in cases of improper use, use of incompatible hardware or software, or failure to observe system requirements.
We are not liable for non-fulfillment of our obligations due to force majeure (e.g. natural disasters, pandemics, war, strike, official orders). In such cases, we offer a refund or a credit.
The following provisions apply to customers who enter into a longer-term partnership with Exitmania (e.g. via business solutions at /business-loesungen). They define the framework for distribution and licensing of our games by partners.
This section applies to legal entities under public law or companies (hereinafter "Partners") who distribute games developed or licensed by Exitmania via their own channels or make them available to third parties for use.
The term is determined by the individual agreement (e.g. 12 or 24 months). After expiry of the license, the Partner's right to provide access to the game ceases. All individually created content up to that point will be archived.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected.
If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is our registered office.
We reserve the right to change these T&C at any time. The current version is available on our website. Contracts already concluded remain unaffected by changes.
Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected.
